Gideon Rosen (2014) has drawn our attention to cases of duress of a particularly interesting sort: the person's ‘mind is not flooded with pain or fear’, she knows exactly what she is doing, and she makes a clear-headed choice to act in, as Rosen says, ‘awful ways’. The explanation of why we excuse such actions cannot be that the action was not voluntary. In addition, although some duress cases could also be viewed as necessity cases and thus as justified, Rosen (...) wisely sets aside that complicating factor by zeroing in on those cases where the action clearly is not justified. So why do we excuse in these cases, where the action is not justified and the agent acted voluntarily?Rosen thinks the key lies in the ‘ill will’ condition, ‘the idea that an act is blameworthy only if it manifests insufficient concern or regard for those affected’. He says this is relatively uncontroversial; much of my paper is taken up with calling the ‘ill will’ condition into question. I also take issue with Rosen on just how justifications and excuses differ. I argue in favour of understanding justifications (in a context where we are asking how justifications and excuses differ) as not requiring truth, but only reasonable belief. (shrink)

This article looks at this proposal, and discusses its possible repercussions. There is considerable controversy over this method of abortion, with promoters saying that it is safer, easier and private, whereas opponents call it DIY abortion or home-alone abortion and question its safety.

Marcia Cavell draws on philosophy, psychoanalysis, and the sciences of the mind in a fascinating and original investigation of human subjectivity. A "subject" is a creature, we may say, who recognizes herself as an "I," taking in the world from a subjective perspective; an agent, doing things for reasons, sometimes self-reflective, and able to assume responsibility for herself and some of her actions. If this is an ideal, how does a person become a subject, and what might stand in the (...) way? One of Marcia Cavell's guiding premises is that philosophical investigation into the specifically human way of being in the world cannot separate itself from investigations of a more empirical sort. Cavell brings together for the first time reflections in philosophy, findings in neuroscience, studies in infant development, psychoanalytic theory, and clinical vignettes from her own psychoanalytic practice. When preferences are such that there is no unique additive prior, the issue of which updating rule to use is of extreme importance. This paper presents an axiomatization of the rule which requires updating of all the priors by Bayes rule. The decision maker has conditional preferences over acts. It is assumed that preferences over acts conditional on event E happening, do not depend on lotteries received on Ec, obey axioms which lead to maxmin expected utility representation with multiple priors, (...) and have common induced preferences over lotteries. The paper shows that when all priors give positive probability to an event E, a certain coherence property between conditional and unconditional preferences is satisfied if and only if the set of subjective probability measures considered by the agent given E is obtained by updating all subjective prior probability measures using Bayes rule. Open peer commentary on the article “The Circular Conditions of Second-order Science Sporadically Illustrated with Agent-based Experiments at the Roots of Observation” by Manfred Füllsack. Upshot: I address Füllsack’s main conclusions in his article regarding the meaning of second-order observations. Especially envisaged are the epistemological and ontological difficulties raised by his scrutiny of the merging between systemic-internal conditions of second-order reflexivity and the thematic-theoretical accounts of selection, intentionality and purposiveness in evolutionary systems.

After summarizing approaches taken previously to the problem of the determination of truth-Value of statements constituting literary works (ryle, Russell, Quine, Strawson, Davidson, Et. Al.) the author argues for a treatment of the problem based upon the linguistic status of such statements as translocutions and their relation to the context in which they occur.

BackgroundTraumatic brachial plexus injury (TBPI) causes a sensorimotor deficit in upper limb (UL) movements.ObjectiveOur aim was to investigate the arm–forearm coordination of both the injured and uninjured UL of TBPI subjects.MethodsTBPI participants (n = 13) and controls (n = 10) matched in age, gender, and anthropometric characteristics were recruited. Kinematics from the shoulder, elbow, wrist, and index finger markers were collected, while upstanding participants transported a cup to their mouth and returned the UL to a starting position. The UL coordination (...) was measured through the relative phase (RP) between arm and forearm phase angles and analyzed as a function of the hand kinematics.ResultsFor all participants, the hand transport had a shorter time to peak velocity (p < 0.01) compared to the return. Also, for the control and the uninjured TBPI UL, the RP showed a coordination pattern that favored forearm movements in the peak velocity of the transport phase (p < 0.001). TBPI participants' injured UL showed a longer movement duration in comparison to controls (p < 0.05), but no differences in peak velocity, time to peak velocity, and trajectory length, indicating preserved hand kinematics. The RP of the injured UL revealed altered coordination in favor of arm movements compared to controls and the uninjured UL (p < 0.001). Finally, TBPI participants' uninjured UL showed altered control of arm and forearm phase angles during the deceleration of hand movements compared to controls (p < 0.05).ConclusionThese results suggest that UL coordination is reorganized after a TBPI so as to preserve hand kinematics. O artigo discute a problemática na produção de semijoias e bijuterias em Limeira-SP. A pesquisa descritiva foi realizada com crianças e adolescentes em idade escolar.Foi aplicado um questionário contendo 41 perguntas objetivas que investigaram o perfil do estudante, da família, do trabalho, dos estudos e aspectos da saúde. Entre os principais resultados foi detectado que 569 participantes possuíam idades entre 7 a 13 anos e destes 37,43% informaram que precisam trabalhar para ajudar seus familiares.Quando questionado sobre o tipo de atividade (...) que realizam 28,18% estudantes indicaram que estão envolvidos com a produção de semijoias e bijuterias. Rapid advances and exponential growth in computer and telecommunications technology have taken individual records and papers revealing the most intimate details of one’s life, habits, and genetic predisposition from the private sector into the public arena in derogation of privacy considerations. Although computerized medical information offers a means of streamlining and improving the health care delivery system through speed and enormous storage capacity, it also presents new challenges as it affects the right of privacy and expectation of confidentiality, creating serious (...) ethical and legal issues. Other considerations include constitutional matters such as loss of liberty when one is compelled to remain in an undesirable or unsuitable job so that insurance will not be canceled or the inability to secure another more suitable position due to genetic predisposition and denial of equal protection of the laws if one is stigmatized because one belongs to a certain ethnic or racial group that exhibits a particular genetic propensity. Collateral questions concern the propriety of disclosure of confidential health care information, including genetic data. This article also considers the proposed federal guidelines for a health information privacy law. (shrink)

This is a specific instance of a more general theorem giving a sufficient condition on a pair $M\subset N$ of models of set theory implying that every perfect set in N has an element in N which is not in M.

In this article, we describe the social and economic changes that have contributed to contemporary problems of work—family conflict, gender inequality, and risks to children's healthy development. We draw on feminist welfare state scholarship to outline an institutional arrangement that would support an earner—carer society—a social arrangement in which women and men engage symmetrically in paid work and unpaid caregiving and where young children have ample time with their parents. We present a blueprint for work—family reconciliation policies in three areas—paid (...) family-leave provisions, working-time regulations, and early childhood education and care—and we identify key policy design principles. We describe and assess these work—family reconciliation policies as they operate in six European countries widely considered to be policy exemplars: Denmark, Finland, Norway, Sweden, Belgium, and France. It is widely agreed that the top three Model Penal Code culpability levels suffice for criminal liability, but the fourth is controversial. And it isn’t just the particular MPC wording; that negligence should be on the list at all is controversial. My question is: What makes negligence so different? What is it about negligence that gives rise to the view that it should not suffice for criminal liability? In addressing it, I draw attention to how we conduct the debate, and (...) how our framing of the issues is shaping it. My hope is to prompt thought and discussion on just what we want the element of mens rea to provide, and to draw attention to background assumptions that shape our views of what it should take for negligence to count as a species of mens rea. This book is a philosophical reflection on the experience of time from within exile. Its focus on temporality is unique, as most literature on exile focuses on the experience of space, as exile involves dislocation, and moods of nostalgia and utopia. Marcia Sá Cavalcante Schuback proposes that in exile, time is experienced neither as longing back to the lost past nor as wanting a future to come but rather as a present without anchors or supports. She articulates this present as (...) a "gerundive" mode, in which the one who is in exile discovers herself simply being, exposed to the uncanny experience of having lost the past and not having a future. To investigate this, the book establishes a conversation among three authors whose work has exemplified this sense of gerundive time: the German philosopher Martin Heidegger, the French writer and essayist Maurice Blanchot, and the Brazilian writer Clarice Lispector. The book does not aim to discuss how these authors understand the relation between time and exile but enters in conversation with them in relation to this question. Attempting to think and express this difficult sense of time from within exile, the book engages with the relation between thought and language, and between philosophy and literature. Departing from concrete existential questions, it opens new philosophical and theoretical modes through which to understand what it means to be present in times of exile. (shrink)

In this article I will discuss the dancer’s physical potential and the sensitive knowledge (‘la connaissance sensible’) that emerges from dance practice. For this, I take Lévi-Strauss’ (2010) theory of the ‘savage mind’ as a reference. This theory is important to understand how the discipline of dance does not need to be justified through modern science (Lévi-Strauss 2010). It is understood that dance operates from sensitive knowledge, while modern science is expressed through the intelligible. I will point out how the (...) dancer operates the sensitive, or dancing, thought, stressing that this type of knowledge is created through interest in how to use it and not through interest in how it serves, or what it means. I will then explain how, through sensitive knowledge, dancers propose new challenges during their aesthetic training in order to develop new body technologies, thereby increasing their expressive potential. For this, dancers need to develop body acuity. In other words, I will discuss the processes that dancers use to transform the perception of the self and of the world through danced gestures. In this process, the dancer is always looking for new challenges; he/she constantly deals with new risks in order to discover new knowledge. I will also discuss the problem that dance faces in traditional academia, which disregards sensitive knowledge and values scientific knowledge. (shrink)

One of the most extensive ensembles of twelfth-century mural painting still extant in France has recently been reconstituted in the Church of Saint-Silvain at Chalivoy-Milon , a small village located about forty kilometers southwest of Bourges. During the late 1970s and 1980s, conservation work carried out under the auspices of Monuments Historiques recovered the entire chevet program , a portion of which was first discovered in February 1868. The stunning exposure of a complex, predominantly Christological cycle at Chalivoy-Milon sparked my (...) interest in nineteenth-century reports of painted decoration once visible in the nave. A ciência é feita das escolhas de seus protagonistas e como tal, repleta de subjetividade. Uma teoria científica é uma suposição explicativa e negar a influência da imaginação como agente ativo na construção do conhecimento seria no mínimo ingenuidade. Embora a ciência possua regras bem definidas, seu método se limita a obtenção e tratamento de dados. O surgimento da ideia ou da hipótese inicial é fruto do salto intuitivo da livre imaginação humana. A Experimentação Mental é o processo de empregar (...) situações imaginárias para ajudar-nos a entender ou prever de que maneira as coisas podem se comportar na realidade. Assim como os Experimentos Concretos os Experimentos Mentais são uma ferramenta essencial na construção do conhecimento científico. Tais situações imaginárias são parte importante da argumentação dos cientistas na busca do convencimento de seus pares, servindo também como ferramenta didática. Neste trabalho, através da revisão de algumas das principais referências sobre este conceito, buscaremos analisar questões epistemológicas envolvidas. Afinal o que são Experimentos Mentais? Será que eles podem nos fornecer uma fonte de conhecimentos do mundo natural? De onde vem esse conhecimento? O objetivo principal desta análise é buscar padrões de interpretação através de categorias de definições apresentadas por pontos de vista significativos. Diferentes autores discutem os limites e potencialidades dos Experimentos Mentais, baseado em suas considerações propomos aqui cinco categorias distintas para sua compreensão: Processo de Re-contextualização, Intuições Platônicas, Argumentos Pitorescos, Experimentos e Manipulação de Modelos Mentais. This paper analizes the work of Fernando Henrique Cardoso and Enzo Faletto (Dependência e Desenvolvimento), to see the relation between state and social classes in the brazilian development process, yersteday and today.

Este estudo retoma os limiares de Walter Benjamin, nos escritos e espaços de errâncias que condensam o pensamento do filósofo em torno do processo de modernidade em um conjunto de transformações no tempo e no espaço da grande cidade. Interessam-nos, sobretudo, os estudos de cidade de Benjamin articulados à sua crítica do conhecimento. No rastro do pensamento benjaminiano, a cidade é pensada enquanto corpus de reflexão que envolve outras categorias para além do racionalismo que torna as imagens urbanas uma série (...) de traçados objetivos. Como terreno da fantasia, das lembranças, a cidade situa-se além do dado empírico. Nessa perspectiva, discutimos a história como memória e o olhar alegorista da criança diante do labirinto urbano. Ao tentar recuperar os tempos e espaços da infância, não a partir de um período demarcado cronologicamente, mas como uma experiência de linguagem, o filósofo alemão pôs em xeque uma concepção linear de conhecimento baseada no continun da própria história, desenvolvendo assim a crítica de um determinado modelo de razão e de racionalidade. Destacamos nos escritos de Benjamin, especialmente nos fragmentos de Infância em Berlim, aspectos centrais da sua crítica ao sistema de pensamento lógico-dedutivo que tanto influenciou a sociedade moderna. Nesta crítica a infância é pátria transcendental da história; a ciência e a filosofia são pensadas como arte. A partir do pensamento benjaminiano, apresenta-se uma visão ampliada da educação, para além das fronteiras e temporalidades disciplinares e dos âmbitos das instituições educativas. Outros autores acompanham-nos no diálogo com o filósofo: Agamben; Gagnebin, Matos, Bolle e outros – pesquisadores, estudiosos e comentadores do pensamento de Benjamin, e de diferentes campos do conhecimento que nos ajudaram a tecer os fios articuladores deste trabalho. Friends as well as foes of Kant have long been uneasy over his emphasis on duty, but lately the view that there is something morally repugnant about acting from duty seems to be gaining in popularity. More and more philosophers indicate their readiness to jettison duty and the moral 'ought' and to conceive of the perfectly moral person as someone who has all the right desires and acts accordingly without any notion that (s)he ought to act in this way. Elsewhere' (...) I have argued that such a picture of the perfectly moral person is flawed. In this paper I examine the claim that acting from duty is morally repugnant. There is some truth to this charge, but, I argue, the repugnance attaches not to acting from duty as such, but only to certain ways of acting from duty. In isolating the objectionable elements of acting from duty, I hope not only to vindicate the skeletal concept but also to offer illumination on the question of just how we should understand morally good conduct.
